Lotus Strikes Back Over ‘Misrepresentation Of The Judge's Decision’

Proton-owned Group Lotus has fought back, insisting that the press release issued by Lotus Racing/Team Lotus had attempted to skew the facts, creating a “misrepresentation of the Judge's decision”. Lotus says that the presiding High Court Justice Peter Smith did not make a decision on the summary judgment, neither dismissing nor throwing out Lotus' application for summary judgment as the 2011 F1 season will be starting in a matter of weeks.
“The Judge proposed that the better procedural route was to order a speedy trial of all the issues in dispute in the case”, the official statement from Lotus said. “1Malaysia Racing Team (Team Lotus) initially resisted the Judge's approach to resolve all matters quickly and before the start of the 2011 Formula 1 season, but the order was subsequently made and the first available date was 21 March”.
That last statement is of course in contrast to Team Lotus founder and team principal Tony Fernandes' comment yesterday on how “extremely happy that the full trial was brought forward”. Nevertheless, there is no dispute when it comes to the expected final outcome of the full trial, where both Lotus and Team Lotus have expressed confidence in winning the right to use the Team Lotus name.
